Paladin AI Ventures Pty Ltd ACN 651 630 367 and its subsidiaries (Company) provide services to aid individuals and mental health professionals or guardians in relation to mental health management or treatment (Services) via the mobile application SafeWatch (App).

The purpose of this Legal Disclaimer & Privacy Policy is to govern your access to and use of the Services and the App as well as to inform you about how we process information about you. By using the Services and the App, you are agreeing to the terms of this Legal Disclaimer & Privacy Policy, as may be updated by us from time to time.

  • 1 Disclaimer

    You acknowledge and agree that the Company disclaims all and any guarantees, undertakings and warranties, expressed or implied, in the provision of the Services and is not liable for any loss or damage whatsoever (including personal injury or property damage, negligence or otherwise, incidental or consequential loss or damage) arising out of, or in connection with the Services, to the fullest extent permitted by law. Where the Company cannot exclude such liability under the Competition and Consumer Act 2010 (Cth), its liability to you will be limited to: 1) if the breach relates to goods, the replacement or repair the goods or 2) if the breach relates to services, the supply of those services or the payment of the cost of those services supplied again.

    2 Release

    You hereby release, discharge and hold harmless the Company from all actions, proceedings, claims, liabilities, demands, damages and expenses and howsoever occurring, brought against or made upon the Company by you or by any other person or which the Company may themselves pay, suffer, or sustain, arising directly, indirectly or in any other way connected with the provision of the Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, irrespective of any negligence on the part of the Company. For the avoidance of doubt, this extends to any directors, officers, employees, contractors, agents, representatives, licensees or permitted assigns of the Company. You agree and acknowledge that the liability of Company for any negligent acts is limited to any service fee paid by you to the Company.

  • 3 Information Collection

    • 3.1 The kind of information that we collect from you will depend on how you use the App. The information which may be collected may include:
      • (a) Name and contact details;
      • (b) Payment details;
      • (c) Communications from you including inputs, feedback, mood indicators, survey responses, testimonials or complaints; and
      • (d) Any other information of any kind in any form provided by you or mental health professionals, including but not limited to photos, personal notes, journals, sex, age, alcohol consumption and medication records.
    • 3.2 We may collect personal information from you whenever you input such information into the App.
    • 3.3 We may also collect cookies from your mobile devices which enable us to tell when you use the App and also to help customise your App experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.
    • 3.4 You acknowledge and agree that the personal information which we collect from you may include your health information.
    • 3.5 You also acknowledge and agree that the App contains analytical systems and artificial intelligence systems to process the personal information about you.
  • 4 Purpose of collection

    • 4.1 The purpose for which we collect information is to provide you with:
      • (a) the Services, including but not limited to the provision of the information about you which is collected and processed via the App to mental health professionals;
      • (b) the best service experience possible on the App; and
      • (c) any other services which are reasonably necessary for or associated with the provision of the Services.
    • 4.2 We may produce macro statistics based on the information about the users of the App which is collected and processed via the App and may disclose to a third party such macro statistics which do not reveal any of your personal information.
    • 4.3 By providing your survey responses, testimonials, feedback or complaints, you grant to us a royalty-free, worldwide, irrevocable, perpetual license to use and incorporate into the App any general suggestions, enhancement requests, testimonials, recommendations or other feedback provided by you.
  • 5 Access and control of your personal information

    • 5.1 Due to the nature of the technology employed in the architecture and the design of the App, we do not hold or store your personal information. You have the right to request access to your information collected on the App, but other than the information available to and visible to you, we do not hold any other information. If you request that we correct any inaccurate personal information, we will take all reasonable efforts to comply with your request.
  • 6 Security

    • 6.1 We acknowledge that we will take appropriate security measures to protect against unauthorised access to or unauthorised alteration, disclosure or destruction of your personal information.
